Recording preparation

How to Record a Deed in Sussex County, Delaware

Recording a deed involves checking document requirements and paying the applicable recording charges.

A deed transferring real estate may also be subject to Delaware state, county or municipal realty transfer taxes.

  1. Prepare the correct legal instrument

Check the grantor, grantee, property description, consideration, signatures and acknowledgment.

Use an attorney or qualified settlement professional if the correct deed type is uncertain.

  2. Include the property identification

Confirm the Sussex County tax map and parcel number.

Make sure the deed contains the grantee address required under Delaware law.

  3. Check realty transfer tax obligations

Determine whether Delaware state and county or municipal transfer taxes apply.

Review exemptions and required declarations before calculating the amount due.

  4. Check the recording fee

Count the document’s record pages and applicable attachments.

Confirm the current charge and accepted payment method with the Recorder.

  5. Submit and retain the recorded reference

Deliver the instrument using the filing method accepted by the office.

Keep the receipt and recording number after acceptance.

06

County fee schedule

Sussex County Recorder of Deeds Fees

Sussex County Code Chapter 62, Article VI contains the Recorder of Deeds fee schedule.

The current code lists a $9-per-record-page charge for deeds, mortgages, releases, assignments and several other recordable instruments.

Deeds, mortgages and similar instruments$9 per record page
Recorded plots, plats and surveys$30 per page
Certified or office copy$5 per page
Certificate under hand and seal$5
Online nonsubscriber document download$1 per document
Online single-user subscription$50 per month
Enterprise subscription, up to 10 users$300 per month

The county defines a record page using its code’s line-counting rules, so the recording charge may not match a simple count of printed sheets.

Transfer taxes and other statutory charges can also apply. Do not use the $9 recording charge as the total cost of transferring real estate.

Verify current fees

Open Sussex County Code § 62-18 — Recorder Fees

After opening: review subsection A for recording and copy charges and subsection C for online document retrieval.

Call the Recorder at 302-855-7785 for a transaction-specific total.

07

Important Delaware cost

Recording Fees vs. Realty Transfer Taxes

A real-estate transfer can involve two very different charges: the Recorder’s document fee and the taxes associated with the transaction.

Sussex County’s published transfer-tax instructions describe a 2.5% state portion and a 1.5% county or municipal portion for applicable transactions.

Together, those percentages produce a 4% illustration before considering exemptions, first-time buyer benefits, transaction-specific rules or later legal changes.

Illustrative calculation only

Property transfer with $300,000 taxable consideration

State portion at 2.5%$7,500
County/municipal portion at 1.5%$4,500
Combined illustrative tax$12,000

This is not a quote for your closing. The actual amount depends on the transaction date, applicable law, local jurisdiction, tax base and exemptions.

The county also maintains separate guidance for municipal transfer-tax payments.

Review municipal transfer-tax instructions

Official Sussex County Town Transfer Tax Instructions

After opening: identify whether the property is inside a municipality. Review the payment instructions and check with the Recorder or settlement attorney before making checks payable.

08

Document retrieval

How to Get a Copy of a Sussex County Deed

For most searches, the easiest starting point is Landmark Web.

Find the deed, record its instrument number or book and page, and check the document retrieval options.

Online document copy

The county code lists $1 per downloaded document for nonsubscribers.

Monthly access plans may make sense for title companies and frequent users.

Certified office copy

The county code lists $5 per page for certified, office or exemplified copies.

Confirm which certification is required by the court, lender or receiving agency.

Request a document

Open the Sussex County Recorded Documents Portal

After opening: locate the instrument, verify its identity and review the image or download options.

For a certified copy, contact the Recorder with the document reference and ask about available delivery and payment methods.

09

Recorded activity notifications

Sussex County Property Fraud Alerts

Sussex County offers a Recording Activity Notification service.

It sends an email when a newly recorded land-record document matches a personal or business name you registered.

The county specifically states that alerts are not generated using a parcel number or property address.

What it can do

Notify you of recorded documents associated with a monitored personal or business name.

What it cannot do

Prevent fraudulent recordings, investigate title issues or guarantee that a document is legitimate.

Register for notifications

Official Recording Activity Notification Registration

  1. Open the official registration page.
  2. Select Personal or Business.
  3. Enter the name to monitor.
  4. Enter and confirm your email address.
  5. Choose Send Confirmation Email.
  6. Follow the email instructions to complete registration.

If an alert looks suspicious, retrieve the recorded document first. Contact the Recorder and a qualified attorney if you believe the instrument affects your property improperly.

10

Local records protection

Requesting Redaction of an Unlawful Restrictive Covenant

Some older recorded instruments contain discriminatory restrictions that are unlawful under current Delaware law.

Sussex County publishes a specific request form for owners seeking redaction of qualifying unlawful restrictive covenants.

The form asks for property identification, document type, book and page, and the language claimed to violate Delaware law.

Official request form

Request for Redaction of Unlawful Restrictive Covenant

After opening: enter the tax map and parcel number, property address, document reference and disputed covenant language.

Sign the request and follow the submission instructions printed on the form. The published form lists deeds@sussexcountyde.gov and P.O. Box 827, Georgetown, DE 19947.

This procedure concerns a particular statutory redaction request. It is not a general method for removing a valid lien, changing ownership or rewriting a deed.

Find the correct county department

Recorder vs. Assessment Division vs. Billing and Collections

Recorder of Deeds

Alexandra Reed Baker

302-855-7785

Recorded deeds, mortgages, releases, plats, document copies and recording questions.

Assessment Division

302-855-7824

assessment@sussexcountyde.gov

Property identification, assessment records, parcel details and assessment questions.

Billing and Collections

302-855-7871

County tax bills, utility billing, collections, payments and account questions.

All three services may be relevant during a property purchase, but each answers a different question.

For example, if a deed is recorded but the assessment account still shows the previous owner, check the recorded document first and then ask the Assessment Division about the parcel record.

Contact the Assessment Division

Sussex County Assessment Property Search

After opening: accept the disclaimer and locate your parcel. If the portal is unavailable, call 302-855-7824 with the property address and parcel number.

Common search and recording problems

Sussex County Recorder Troubleshooting

I cannot find the deed by owner name

Try the name as recorded at the time of the transaction. Check surname variations, initials, businesses, trusts and former owners.

The official portal recommends trying all possible spelling variations.

I only have a property address

Start with Sussex County’s Assessment Division or parcel map to identify the tax map and parcel number.

Then use Landmark Web’s Parcel ID or name-search options.

The property search says it is unavailable

The Assessment property search may occasionally display a maintenance notice.

Try the county GIS map or call the Assessment Division rather than assuming the parcel does not exist.

I cannot view or print the document image

Landmark Web’s help text identifies PDF viewing as a requirement for document images.

Try a current browser and PDF viewer. If the issue persists, contact the Recorder.

The mortgage should have been released

Search for a later release or satisfaction of the mortgage.

If none appears, contact the lender or settlement professional. Do not assume a paid-off loan automatically removes its recorded lien.

The deed contains an error

Contact the professional who prepared or submitted the instrument.

A correction may require an additional recorded document and appropriate legal review.

I need to know whether transfer tax applies

Confirm the property’s location, taxable consideration and any claimed statutory exemption.

Ask the Recorder or settlement attorney for the appropriate current transfer-tax procedure.

I paid for a document but cannot download it

Review the account and download status. The portal states that the Recorder does not issue refunds for online retrieval purchases.

Contact the office before attempting multiple paid downloads of the same item.
