Content gaps fixed

Details Many Florida Homestead Requirement Guides Miss

2026 amount changed: older pages may say “up to $50,000,” but the additional non-school portion is CPI-adjusted. For 2026, the maximum additional portion is $26,411.

School vs non-school treatment is different: the first $25,000 applies to school and non-school taxes; the additional portion applies only to non-school taxes.

January 1 is critical: ownership and permanent residence must usually exist on January 1 of the tax year.

Property appraiser decides residency: Florida law treats permanent residence as a factual determination made first by the property appraiser.

1. Own the property on January 1

You must have legal title, beneficial title in equity, or another qualifying ownership interest recognized for homestead purposes.

Recorded contract buyers, life-estate holders, certain long-term leaseholders, trust beneficiaries and other special title holders may need extra review.

2. Make it your permanent residence

The home must be your permanent residence or the permanent residence of someone legally or naturally dependent on you.

Temporary presence is not enough if the facts show the home is not your permanent residence.

3. Be a Florida permanent resident

Your proof should show that Florida is your permanent home.

Florida driver license, Florida ID, vehicle registration, voter registration, declaration of domicile, IRS return address, school location and utility records can matter.

4. Do not claim another residency-based benefit

A person claiming an ad valorem tax exemption or tax credit in another state based on permanent residency is not entitled to Florida homestead.

Resolve out-of-state residency benefits before filing.

5. File with the county property appraiser

Complete DR-501 or the county’s online equivalent.

Many counties allow online filing, but the property appraiser still makes the final determination.

6. File by March 1 when possible

The standard filing deadline is March 1 of the tax year.

Some counties accept pre-filed applications for the next year, but the current-year deadline still matters.

  1. Confirm January 1 eligibility.

    Make sure you owned the home and made it your permanent residence by January 1 of the tax year.

  2. Find your county property appraiser.

Save Our Homes assessment cap

After the first year a home receives homestead and is assessed at just value, future assessed-value increases are generally limited to 3% or CPI, whichever is lower.

This does not mean the tax bill can never increase.

Portability

If you move from one Florida homestead to another, you may be able to transfer all or part of the Save Our Homes benefit.

File DR-501T with the new homestead application.

Three-year portability rule

You generally must establish the new homestead within three years of January 1 of the year the prior homestead was abandoned.

This is not measured simply as three years after the sale date.

Ownership changes

Sale, foreclosure or transfer of legal or beneficial title can trigger reassessment and loss of the Save Our Homes benefit.

Some spouse, death, correction and same-owner transfers may be exceptions.

Rental and abandonment

Renting all or substantially all of the dwelling can constitute abandonment of the homestead.

Special timing rules apply when renting occurs after January 1.
